General conditions
1. Terms of Sale
Our terms of sale apply to all sales of goods and services from BabySensor AS. The terms of sale, together with your order and the corresponding order confirmation, constitute the entire contractual basis for the purchase. The terms may change over time, but the terms described at the time of purchase apply to each individual purchase. The terms were last updated on March 15, 2023.
Consumer purchases are regulated by Norwegian law, which includes the Consumer Purchases Act, the Right of Withdrawal Act, the Marketing Act, the E-Commerce Act, and the Credit Purchases Act. Follow the links to these laws for more information about your rights and obligations when purchasing from BabySensor AS.
2. Definition of parties
Seller : BabySensor AS, org.nr. 920 230 970 MVA, Trekullveien 10, 3280 Tjodalyng. Hereinafter referred to as "BabySensor AS", "seller", "we", or "us".
Buyer : The person or company specified as the buyer in the order confirmation. Hereinafter referred to as "buyer", "user", or "you".
Right of withdrawal and cancellation
BabySensor AS follows the current rules in the Right of Withdrawal Act, which provides a 14-day withdrawal period from the date of delivery. The buyer must notify the seller of the use of the right of withdrawal within 14 days from the start of the period. The buyer covers the direct costs of returning the goods, unless otherwise agreed. The seller is obliged to refund the purchase price without undue delay, and no later than 14 days after being informed of the buyer's decision to exercise the right of withdrawal.
To cancel or exercise your right of withdrawal, contact us via email at contact@babysensor.com with necessary information such as withdrawal form, name, address, and date of purchase.
Complaints
BabySensor AS follows the Consumer Purchase Act's rules for complaints. We guarantee that the right to complain applies even if our guarantees offer extended rights.
Ordering and agreement process
Your order is considered binding when it is registered on our server. We will confirm receipt of your order by sending you an order confirmation.
Prices and payment
All prices include VAT, and the total purchase price includes all costs associated with the purchase. Payment for the item is made from the time it is shipped from the seller to the buyer.
Subscription
Subscriptions are sold with a fixed binding period. After the end of the period, the subscription automatically terminates, unless the buyer actively chooses to extend it.
Force majeure
BabySensor AS is exempt from liability in cases of force majeure that make delivery or redelivery unreasonably burdensome.
Personal information
BabySensor AS is the controller of collected personal data. The buyer's personal data will only be disclosed in cases where it is necessary to implement the agreement.
Disputes and choice of law
Disputes concerning these terms and conditions fall under ordinary courts, with Sandefjord District Court as the venue.
Reservations
We reserve the right to change these terms and conditions without notice. The user is solely responsible for complying with the current terms and conditions.
